ARTICLE 1.000 TAX CERTIFICATE FEE

A tax certificate fee of ten dollars ($10.00) shall be charged for each tax certificate issued by the City of Fredericksburg. (Ordinance adopting Code)

ARTICLE 2.000 CERTIFIED COPIES FROM DUPLICATES

Certified copies may be provided from photographic duplicates of public records, even when the original of such record has not as yet been destroyed. A charge of one dollar and fifty cents ($1.50) for each page or part thereof shall be made for certified copies produced from a photographic duplicate of the original record; provided, however, where a specific charge is elsewhere provided by this article or other ordinance for certified copies of particular records, then such specific chart shall be controlling over the charge provided for in this article. ARTICLE 4.000 ANIMAL FEES AND CHARGES

§ 4.100 Fees for Impoundment of Dogs and Cats Running at Large

(a)  Impoundment, confinement and disposition of dogs or cats which have bitten or molested people.

(1) Ten (10) days confinement required. Upon written complaint or reasonable proof to the pound master or any police officer by any person who has been bitten or otherwise molested by a dog or cat, it shall be the duty of such pound master or police officer to immediately impound such dog or cat in the city pound. The person shown to be the owner or keeper of such dog or cat by records on file in the city shall be immediately notified of the impounding of such dog or cat. If the owner or keeper of a dog or cat impounded for biting a person shall direct, said dog or cat may be removed to a reputable boarding kennel or animal hospital, provided the owner or keeper makes advance cash deposit with the kennel or hospital operator for the entire period of confinement and shall pay to the city a pound fee of three dollars ($3.00) per day for each day the dog remains in the pound. Wherever confined, such dog or cat shall be kept for a period of ten (10) days for observation for rabies.

(2) Redemption by owner after confinement period. If the dog or cat so confined shall not become rabid or exhibit symptoms of rabies, then upon termination of said ten (10) day observation period, such dog or cat shall be immediately released to the owner or keeper of such dog or cat, provided a licensed veterinarian shall make and deliver to the pound master or person in charge of the boarding kennel or hospital, as the case may be, his/her certificate stating that in his/her opinion such dog or cat is not rabid and exhibits no symptoms of rabies, and provided the owner or keeper first pays the veterinary fees and other incidental expenses. When confinement has continued in the city pound, the incidental expenses shall include a pound fee of thee dollars ($3.00) per day for each day the dog or cat shall have been impounded, and a sum equal to any costs incurred by the city. If, upon termination of the period of impoundment here provided for, such dog or cat shall not redeemed by the owner or keeper, then such dog or cat shall be disposed of by the pound master as is hereafter provided for impounded dogs or cats which are not redeemed.

(b) Redemption of impounded dogs or cats not suspected of rabies. Any person whose dog or cat shall have been impounded for reasons other than biting a person shall have the right to redeem his/her dog or cat from the city pound on the date of its impoundment or within three (3) calendar days thereafter, making proof to the animal control officer of his/her ownership or right to possession of the dog or cat and by payment to the animal control officer of a pound fee of fifteen dollars ($15.00), plus the sum of two dollars and fifty cents ($2.50) per day for each day, or part thereof, that such dog or cat shall have been confined for the food and care of such dog or cat, as well as any other charges incurred by the city in keeping of the dog or cat impounded.

(c)  Adoption. Any animal adopted may be adopted for a fee of fifteen dollars ($15.00). (Chapter 5, Section 5-6, Code of 1965)

§ 4.200 Registration of Dangerous Dogs

(a)     The animal control officer shall formally register a dangerous dog if the owner pays an annual fee of fifty dollars ($50.00).

(b)     If an owner of a registered dangerous dog sells or moves the dog to a new address within the city, he/she, not later than the fourteenth (14th) day after the sale or move, shall notify the animal control officer. On presentation of a fee of twenty-five dollars ($25.00), the animal control officer shall issue a new registration tag to be placed on the dog’s collar.

ARTICLE 5.000 CONSTRUCTIONS PERMITS AND FEES

No building shall be in any manner constructed, altered, repaired, remodeled, or moved within the city limits unless a building permit is obtained. The following fees shall be paid for building permits:

Carport, storage sheds, accessory buildings, and detached garages: Five cents ($0.05) per square foot of floor space, with a minimum fee of ten dollars ($10.00).

Residences and additions to residences:  Ten cents ($0.10) per square foot of floor space with a minimum fee of twenty dollars ($20.00).

Commercial buildings: Twelve cents ($0.12) per square foot of floor space for the first two thousand, five hundred (2,500) square feet, plus seven cents ($0.07) per square foot for the next two thousand, five hundred (2,500) square feet, plus five cents ($0.05) per square foot for the amount of floor space in excess of five thousand (5,000) square feet, with a minimum fee of one hundred dollars ($50.00).

Industrial buildings: Fifteen cents ($0.15) per square foot of floor space for the first two thousand, five hundred (2,500) square feet, plus five cents ($0.05) per square foot for the next two thousand, five hundred (2,500) square feet, plus three cents ($0.03) per square foot for the amount of floor space in excess of five thousand (5,000) square feet, with a minimum fee of one hundred dollars ($100.00).

Moving of buildings or structures: Fifty dollars ($50.00).

Erection of fences: Five dollars ($5.00).

Demolition of buildings: Twenty-five ($25.00). 

Demolition of accessory buildings:  Five dollars ($5.00).

Alterations or repairs without addition of floor space: In the event that alterations or repairs are made to a building without the addition of any additional floor space, the fees provided in Appendix "K" of the Standard Building Code shall be required.

Signs: One dollar ($1.00) per square foot of sign area with a minimum fee of ten dollars ($10.00).

Banners or Temporary Signs: Five dollars ($5.00).

The building inspector shall determine, for each application for building permit received, which of the above rates will apply.

§ 5.200 Electrical Permit Fees

Each application for permit shall be remitted to the electrical inspector with the appropriate fee, as determined from the schedule of fees below, which fees shall be inclusive of normal inspection fees. In the event the scope of work is increased during the construction period, the electrical inspector shall require the permit holder to file an amended permit application, prior to final inspection, setting forth the proper fee calculations based on the increase in scope, and paying the increased fee amount:

Repairs, replacements or additions to existing electrical systems shall be charged at the above rate according to the portion of the existing system which is being repaired.

Moving or otherwise relocating of any electrical equipment for which a permit fee is not otherwise provided for shall require a minimum inspection fee of twenty dollars ($20.00).

In the event work is commenced before a permit is obtained without he specific approval of the building official, the permit fee shall be doubled but in no case shall he doubled fee be less than sixty dollars ($60.00).

In the event it becomes necessary, in the sole discretion of he electrical inspector, to make a re-inspection of work authorized under this code, the person to which the permit was issued shall pay a re-inspection fee of twenty-five ($25.00). Said fee shall be paid prior to he re-inspection.

§ 5.300 Fee for Electrical Inspections

All new facilities and modified, changed, enlarged or reconstructed facilities are subject to inspection by the city, in which event a reasonable inspection fee not exceeding ten dollars ($10.00) for each pole inspection shall be paid to the city by the utility.

§ 5.400 Permit Fee for Sidewalk Construction

A permit fee of five cents ($0.05) for each of the first one-hundred (100) lineal feet and two cents ($0.02) per foot for each additional foot, with a minimum of one dollar ($1.00) fee, shall be paid before such a permit shall be granted for repairs of sidewalks, driveways, etc.

ARTICLE 6.000 FEE FOR GENERAL CONTRACTOR LICENSE AND BOND

 

The annual license fee shall be two hundred dollars ($200.00) for the initial license and fifty dollars ($50.00) for renewal on January 1 of each succeeding year.

ARTICLE 8.000 FEE FOR ITINERANT MERCHANTS’ AND VENDORS’ PERMIT

The fee for an itinerant merchant’s or itinerant vendor’s permit shall be fifty dollars ($50.00). When any person engages in any activity mentioned in Section 4.101 through one (1) or more agents or employees, he/she shall, in addition to such fee, pay a permit fee of ten dollars ($10.00) for each agent or employee so engaged. The fee provided for herein shall be paid prior to the issuance of the permit.

ARTICLE 9.000 LICENSE FEE FOR SALES OF ALCOHOLIC BEVERAGES

Before any person shall be permitted to manufacture, sell or distribute beer, wine or mixed beverages, as herein before defined, within the corporate limits of the city, he/she shall present to the tax collector of the city his/her license or permit to manufacture, sell, or distribute beer, wine or mixed beverages, as the case may be, within the State of Texas or in the County of Gillespie, and pay said tax collector an annual license fee as follows:

ARTICLE 10.000 LICENSE FEE FOR TAXICABS

The fee for a license required by this article shall be twenty-five dollars ($25.00) for the first taxicab and ten dollars ($10.00) for each additional taxicab. Such fees shall be paid annually in advance on or before March 31st. The license fees provided for herein shall be used to defray the expense incurred in administering and enforcing this article.

ARTICLE 11.000 PERMIT FEE HORSE DRAWN CARRIAGES

A holder of an annual permit shall pay the city, in advance, a permit fee of twenty-five dollars ($25.00) a year for each carriage authorized by the permit.

ARTICLE 12.000 FEES FOR GARBAGE HAULING SERVICE

No permit shall be issued to any applicant unless and until such applicant has paid the City of Fredericksburg an application fee of twenty-five dollars ($25.00).

ARTICLE 13.000 ANNUAL FEE FOR SEXUALLY ORIENTED BUSINESS

The annual fee for a sexually oriented business license is five hundred dollars ($500.00).

ARTICLE 14.000 GARBAGE AND TRASH FEES

Each owner or occupant of each residence within the city limits, participating in the automated garbage collection, shall be charged the following sum per month for the automated bulk garbage containers:

(1) 32-gallon bulk container shall be eight dollars and seventy-five cents ($8.75) per container

(2) 64-gallon bulk container shall be nine dollars and twenty-five cents ($9.25) per container

(3) 96-gallon bulk container shall be nine dollars and seventy-five cents ($9.75) per container

Each owner or occupant of each residence or business lying outside the corporation limits of the city receiving the automated garbage collection service shall be charged double the amount of the above rates.

ARTICLE 15.000 FILING FEES FOR PLATS

Preliminary plats of subdivisions and re-subdivisions shall be accompanied by a filing fee of one hundred dollars ($100.00), plus ten dollars ($10.00) per lot.

Variance requests: fifty dollars ($50.00) per item.  (Requests for variance on design or construction standards MUST be submitted in writing with the Preliminary Plat submission.  The request MUST specifically state item, section, subsection, or standards that the variance relates to).

Minor plats:  One hundred dollars ($100.00)

Final plats of subdivisions and re-subdivisions for recording shall be accompanied by a filing fee of two-hundred dollars ($200.00), plus fifty dollars ($50.00) per page

Subdivision Construction Inspection: one hundred dollars ($100.00) per lot.

Parks Fee:  One percent (1%) of the gross land value of the platted area.  Applicants shall provide an appraisal, by a certified appraiser, dated within six months of application.

Plat vacations shall be accompanied by a filing fee of one hundred dollars ($100.00) per plat.

There shall be no fee required for minor plat changes or corrections.

ARTICLE 16.000 WATER AND SEWER RATES AND FEES

A per meter charge of twenty dollars ($20.00) shall be made for connections to the city waterworks system made between 7:30 a.m. and 4:30 p.m., Monday through Friday: provided, however, that a per meter charge of forty dollars ($40.00) shall be made for connections made on holidays or at any time other than between 7:30 a.m. and 4:30 p.m., Monday through Friday.

§ 16.200 Deposit Fee for Water Service

Each water customer shall pay to the city, at the time of making application for connection to the city water distribution system, the sum of twenty-five dollars, ($25.00), as security for the payment of bills for water and other utility service, which deposit may be retained by the city until such customer is disconnected. The city may accept a letter from another city or utility company declaring that the customer has at least two (2) years good credit, in lieu of deposit.

Residential. Applicable to all water service exclusively for domestic purposes to individual (single family) private residences or apartments served through a single meter. This rate is not applicable to business houses, educational institutions, or apartments houses, except where the later are served by separate meters for each apartment.

ARTICLE 17.000  APPLICATION FEE FOR WELL-DRILLING PERMIT

A permit fee of twenty-five dollars ($25.00) shall accompany each application for a well-drilling permit. (Chapter 24, Section 24-33, Code of 1965)

ARTICLE 18.000 FEES FOR SANITARY LANDFILL

Each individual, corporation or other entity, or member of a partnership using he public dumping grounds belonging to the city shall be assessed and shall pay to the attendant at such public dumping grounds, for the privilege of dumping or depositing garbage or other material at the said public dumping grounds, the following charges or fees for each load which shall be applied alternatively as applicable:

§ 19.200 Customer Installation Costs

Residential Customers.

(1) If no primary line extension is required in order to connect he residential customer’s premises to the electrical distribution system, the customer shall pay a customer installation charge of two hundred dollars ($300.00) to cover normal installation costs of connecting the electrical distribution system to the premises.

(2) If it will be necessary to extend the primary line in order to connect the residential customer’s premises to the electrical distribution system, then the customer shall pay the city a two hundred dollar ($300.00) customer installation charge plus the cost, including material, labor, and equipment, of extending the primary to the residence, excluding the cost of the transformer and service drop line.

§ 19.300 Deposit for Electrical Service

A deposit of a sum of money equal to two (2) average monthly bills for service, as estimated by the municipality, and in no instance less than fifty dollars ($50.00), shall be deposited with the municipality by each customer for each meter, at the time of making application for connection to the municipality’s distribution system, with the express understanding that said deposit shall be held by the municipality as security for the payment of amount owning or to become owing for electric or other utility service furnished by the municipality to the customer. The municipality shall have the right to increase the amount of deposit if the customer’s bills for any two (2) consecutive monthly billing periods of normal operation actually prove to exceed appreciably the amount of the original deposit made with the municipality. Any deposit or portion thereof not needed to pay indebtedness to the municipality will be, and the customer may demand that the same be, refunded at the time when the service is discontinued, and the period of limitation with which the claim or demand for such refund may be enforced will being to run at he time when the service is discontinued. The municipality may accept a letter from another city or utility company, declaring that the customer has at least two (2) years good credit, in lieu of the deposit.

§ 19.400 Returned Check Fee

A returned check handling charge of five dollars ($20.00) shall be made for each check returned o the city for reasons of non-sufficient funds, accounts closed, payment withheld, invalid signature or impromptu preparation. (Ordinance of 5-8-41, Section 14; Ordinance 3-185, Section 1, adopted 11-8-82)

ARTICLE 20.000 INSPECTION FOR ELECTRICAL TRANSMISSION AND DISTRIBUTION FACILITIES

All new facilities and modified, changed, enlarged, or reconstructed facilities are subject to inspection by the city, in which a reasonable inspection fee not to exceed ten dollars ($10.00) for each pole inspection shall be paid. (Ordinance 4-099, Section 25-3(e), adopted 4-24-89)

ARTICLE 21.000 DRAINAGE UTILITY COLLECTION RATES

(a) Owner or occupants of residential lots or tracts within the city limits receiving any type of utility service (electricity, water, and or sewer) from the City of Fredericksburg shall be charged a flat fee of $1.00 per month per lot or tract.

(b) Owners or occupants of commercial lot or tracts within the city limits receiving any type of utility service (electricity, water and/or sewer) from the City of Fredericksburg shall be charged a flat fee of $1.00 per month per lot or tract.

(c) Drainage Utility charges shall be added to the utility bill of such owner or occupant and such funds shall be deposited to the credit of the Drainage Utility Fund of the City of Fredericksburg.
