AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FREDERICKSBURG, TEXAS, PASSED AND ADOPTED ON THE 15^TH DAY OF MAY, 1950, AND AMENDED ON THE 29^TH DAY OF JUNE, 1967, AND MAKING PROVISIONS OF ARTICLE 1011A ET. SEQ. OF THE REVISED CIVIL STATUTES OF TEXAS, AS AMENDED APPLICABLE TO THE CITY OF FREDERICKSBURG, WITHIN THE CORPORATE LIMITS, INTO DISTRICTS IN ACCORDANCE WITH A COMPREHENSIVE PLAN AND WITHIN SUCH DISTRICTS REGULATING THE USE OF LAND, BUILDING AND STRUCTURES; THE HEIGHT, BULK AND LOCATION OF BUILDINGS; FIXING MINIMUM YARDS, BUILDING LINES AND OPEN SPACES; REGULATING THE MINIMUM LOT AREA AND DENSITY STRUCTURES, BUILDING AND DWELLING UNITS IN EACH PARTICULAR DISTRICT; SPECIFYING THE MINIMUM LOT WIDTH AND LOT DEPTH FOR RESIDENTIAL USES; PROVIDING FOR A MINIMUM FLOOR AREA FOR DWELLING UNITS OR BUILDINGS INTENDED FOR RESIDENTIAL OCCUPANCY; ESTABLISHING MINIMUM REQUIREMENTS FOR OFF-STREET PARKING; REGULATING THE ERECTION, REPAIR AND ALTERATION OF ALL BUILDINGS AND STRUCTURES; PROVIDING FOR CONDITIONAL USE PERMITS FOR CERTAIN USES; PROVIDING FOR THE CLASSIFICATION OF NEW AND UNLISTED USES; PROVIDING FOR ACCESSORY BUILDING REGULATIONS; RECOGNIZING NONCONFORMING USES AND STRUCTURES; CREATING A BOARD OF ADJUSTMENT; SETTING FORTH THE MINIMUM REQUIREMENTS FOR BUILDING SITES AND THE MANNER OF THEIR CREATION; DEFINING CERTAIN TERMS; ADOPTING A ZONING DISTRICT MAP AND MAKING IT A PART OF THIS ORDINANCE; MAKING ALL FIGURES, LETTERS, MARKING SYMBOLS AND CHARTS CONTAINED IN SAID ORDINANCE OR SHOWN ON THE MAP A PART OF SUCH ORDINANCE; PROVIDING A METHOD FOR AMENDING THE ORDINANCE AND PROVIDING A PENALTY FOR VIOLATION OF THE PROVISIONS OF SUCH ORDINANCE OF ANY SUM NOT TO EXCEED $1,000.00 FOR EACH VIOLATION AND EACH DAY A VIOLATION CONTINUES TO BE A SEPARATE OFFENSE, ALSO PROVIDING INJUNCTIVE RELIEF TO PERSONS AFFECTED BY THE VIOLATION OF SAID ORDINANCE;

WHEREAS, the Board of Commissioners of the City of Fredericksburg, Texas directed the Planning and Zoning Commission to study the Zoning Ordinance adopted in 1950 and amended in 1967 and the present status of development in relation to changing conditions and the needs of the Community as part of a comprehensive planning program; and

WHEREAS, after several month study the Planning and Zoning Commission determined that the Zoning Ordinance of 1950, as amended in 1967, should be amended by adoption of new standards, provisions and regulations, and made a preliminary report to the Board of Commissioners including a draft of the revised Ordinance and Zoning Districts Map; and

WHEREAS, a public hearing was held by the Planning and Zoning Commission on the 16^th day of January, 1986, after due notice of such hearing was given to all owners of real property an interested parties, and at which all persons were given an opportunity to appear and express their opinion concerning the proposed Zoning Ordinance and after consideration of all such testimony, the Planning and Zoning Commission made final report recommending the adoption of the Zoning Ordinance and Zoning Districts Map in its revised form; and

WHEREAS, the Board of Commissioners held public hearings on the 13^th day of January, 1986 and the 27^th day of January, 1986, after due notice of such hearings all persons were given an opportunity to appear and express their opinion concerning the proposed Zoning Ordinance; and

WHEREAS, the Board of Commissioners has determined it to be in the public interest to adopt to the revised Zoning Ordinance and Zoning Districts Map, which in its best judgment would promote the health, safety, morals, and general welfare and protect the use and enjoyment of property throughout the City.

BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF FREDERICKSBURG, TEXAS.

Section 1. That the Zoning Ordinance of the City of Fredericksburg, Texas, passed and adopted on the 15^th day of May, 1950, and amended on the 29^th day of June, 1967, together with all amendments thereto, is hereby amended in its entirety to read as provided in the attached Zoning Regulations.

Section 2. That the fact that the present Zoning Regulations are inadequate to properly safeguard the general public welfare, health, peace and safety, creates an urgency and an emergency, and requires that this ordinance become effective immediately upon its passage, and it is accordingly so ordained.
