3.000 PURPOSE

3.000 PURPOSE

This section outlines each zoning district including restrictions, principal permitted uses, conditional uses and development standards. Each zoning district is associated with certain land use categories in the Comprehensive Plan. Two further explanations that are helpful in applying each zoning district are as follows:

    1. Principal permitted uses are uses permitted by right in the subject district. Uses similar to the principal permitted uses, but not listed as such, are also permitted by right.
    2. Conditional uses are uses which are unusual or unique in character and may be offensive or incompatible in some cases within a zoning district. A conditional use requires review and approval by the Planning and Zoning Commission and the City Council to determine impacts of the use on the surrounding area before such use will be allowed.

3.100 R-1: SINGLE FAMILY RESIDENTIAL

Intent

This zone is intended to provide for a single family dwellings, with not more than one principal residence permitted on any lot to insure an environment conductive to single family residential use. Additional uses necessary and incidental to a single family residential dwelling unit are also permitted. This zone is typically associated with the Low Density Residential Land Use category but is conditionally allowed within all land use categories except "Open Space/Parks", "Industrial" and "Public Facilities".

Principal Permitted Uses

Buildings, structures and lands shall be used, and buildings and structures shall hereinafter be erected, altered or enlarged only for the following uses, plus such other uses as the City Council, by resolution, may deem to be similar to those uses listed and not obnoxious or detrimental to the public health, safety and welfare:

 
  • Single family residential (Detached)
  • Local Utility Services

Uses Permitted Subject to Conditional Use Permit

The following uses may be permitted subject to a Conditional Use Permit as provided in Section 5.400.

 
  • Community Recreation
  • Private Primary Education
  • Day Care Services
  • Private Secondary Education
  • Guidance Services
  • Religious Assembly

Property Development Standards

Except as hereinafter provided, no building or structure or part thereof shall be erected, altered or converted for any use permitted in this district unless it is in conformity with all the standards and regulations herein specified for lot area, width and depth, dwelling unit area, lot coverage, yards and building height. The following standards shall apply except in cases where a lot does not meet the standards herein required but was an official "lot of record" prior to the adoption of this ordinance. In such cases, the present dimension shall be maintained as a minimum standard unit until such time as the use is removed. The replacement shall meet the standards and regulations herein specified.

3.110 R-2: MIXED RESIDENTIAL 

Intent

This zone is intended to provide for medium density living, for example, with not more than one (two bedroom) dwelling unit permitted for each 3500 square feet of lot area. (See Site Development Regulations). Additional uses necessary and incidental to multiple family residential dwellings are also permitted. It is a zone well suited as a buffer between single family uses and other more intense uses. This zone is typically associated with Medium Density Residential Land Use category but is allowed within all Land Use categories except "Open Space/Park", "Public Facility" and "Industrial".

Principal Permitted Uses

Buildings, structures and land shall be used, and buildings and structures shall hereinafter be erected, altered or enlarged only for the following uses, plus such other uses as the City Council, by resolution, may deem to be similar to those uses listed and obnoxious or detrimental to the public health, safety and welfare:

  • Duplex Residential
  • Multiple Family Residential
  • Group Residential
  • Single Family Residential (Detached)

3.120 R-3: MULTI-FAMILY RESIDENTIAL  

Intent

This zone is intended to provide for higher density living, for example, with not more than one (two bedroom) dwelling unit permitted for each 2400 square feet of lot area. (See Site Development Regulations). Additional uses necessary and incidental to multiple family residential dwellings are also permitted. It is a zone well suited as a buffer between single family uses and other more intense uses. This zone is typically associated with the High Density Residential Land Use category, but is allowed within all Land Use categories except "Open Space/Parks", "Public Facilities" and "Industrial".

Principal Permitted Uses

Buildings, structures and lands shall be used, and buildings and structures shall hereinafter be erected, altered and enlarged only for the following uses, plus such other uses as the City Council, by resolution, may deem to be similar to those rules listed and not obnoxious or detrimental to the public health, safety and welfare:

3.130 R-4: MANUFACTURED HOME RESIDENTIAL

Intent

This zone is intended to provide homes manufactured in one or more modules at a site other than the homesite. Additional uses necessary and incidental to the operation of a residential dwelling are also permitted. This zone is typically associated with the Low and Medium Density Residential Land Use category and is not permitted in other Land Use categories.

Principal Permitted Uses

Buildings, structures and lands shall be used and structures shall hereinafter be erected, altered, or enlarged only for the following uses, plus such other uses as the City Council, by resolution, may deem to be similar to those uses listed and not obnoxious or detrimental to the public health, safety and welfare:

3.140 R-5: PATIO HOME RESIDENTIAL

Intent

This zone is intended to provide for the establishment of single family dwellings with not more than one principal residence on any lot. Additional uses necessary and incidental to a Single Family Residential Dwelling Unit and also permitted. This zone is typically associated with low to moderate density residential land use category.

Principal Permitted Uses

Buildings, structures and lands shall be used, and buildings and structures shall hereinafter be erected, attended or enlarged only for the following uses plus other uses the City Council, by resolution, may seem to be similar to those listed and not obnoxious or detrimental to the public health, safety and welfare:

Intent

This zone is intended to provide for the establishment of restricted commercial facilities, to serve the conveniences and needs of the immediate neighborhood and must be compatible with the residential character and environment of the neighborhood. These uses generally result in limited traffic generation.

Principal Permitted Uses

Intent

This zone is intended to provide for the intense commercial activities of the central business district or central trading area of the City. This district establishes the character of the City by serving the tourist as well as the residents of the City.

3.700 PUD: PLANNED UNIT DEVELOPMENT

Intent

The purpose of the Planned Unit Development (PUD) Zone provides a means of achieving greater flexibility in the development of land, appropriate in size and shape to facilitate utilization in a manner not possible by conventional zones. The PUD Zone, is intended to encourage more efficient uses of land, while still providing proper arrangement of uses and structures. As such PUD’s must be related to the land, surrounding uses and zoning; and would insure the fulfillment of community needs relative to certain residential, commercial, industrial, recreational and other land uses. Through the exercise of sound and proper planning principles, PUD’s incorporate appropriate property development standards, that would not be detrimental to surrounding property or uses nor the public health, safety and welfare. All forms of Planned Unit Developments (PUD) shall be subject to the granting of a Conditional Use Permit and may include mixed combinations of the various forms of residential, civic, commercial, industrial, recreational uses and other forms of land uses.

Uses Expressly Prohibited

Any use not included in the granting of a Conditional Use Permit shall be deemed as a use expressly prohibited, unless additional uses are included pursuant to an amendment to the Conditional Use Permit authorizing a Planned Unit Development.

 

Property Development Standards

Each Planned Unit Development shall contain a minimum area of three (3) acres.

Property development standards, applicable to any Planned Unit Development regarding lot area, lot dimension including width and depth, yards including front, side and rear, building heights, distance between buildings, fences, hedges and walls, signs, lighting, access, off-street parking, vehicular and pedestrian circulation, open spaces, grading and drainage, sanitation, public utilities and such other matters pertinent to the development, shall be determined by the Planning and Zoning Commission and City Council at the time of review of plans denoting the proposed Planned Unit Development (PUD) or associated Conditional Use Permit considerations.

The property development standards denoted in the various zones defined in this Ordinance may be used as guidelines for the determining of appropriate property development standards.

Property development standards imposed in conjunction with Planned Unit Development shall in no way be contrary to applicable federal, state or county laws and shall not be inconsistent with any plans enacted pursuant to applicable authority by the legislative body, nor shall such property development standards be in deviation from sound planning principles nor detrimental to the public health, safety and welfare.

The mechanics of the process require the developer to submit a "General Development Plan" based on Conditional Use Permit provisions in this ordinance. The Planning and Zoning Commission and the City Council will review the plan for conformance with this ordinance and specify additional conditions to minimize possible adverse effects. Subjects for possible additional conditions include the following:

B. Services H. Yards (Set-Backs/Open Space)

C. Design I. Landscaping and Landscape Preservation

D. Physical Environment J. Signage

E. Density K. Amenities

F. Fences, Walls and Visibility L. Screening

 

Construction plans, when submitted, must indicate that each condition is met as the project continues.
